Booking terms

These Terms set out the rules for booking and short-term rental of the MT Premium Apartamenty apartment via mtform.pl.

1. Parties

The agreement is between the Guest (the person making the booking) and the Host:

2. Subject

The subject is short-term rental of the apartment for the check-in and check-out dates stated in the booking. The minimum stay follows the offer on the website.

3. Price and payment

The stay price is 100% of the service price, payable in full up front when booking. It is not a deposit (zadatek) or advance under the Polish Civil Code — it is the full price of the rental service for the selected dates.

Payment is made in one of two forms. Which one applies depends on the setting active at the time of booking; the booking form states it before you confirm.

• Online payment — handled by Przelewy24. The booking is confirmed as soon as the payment is recorded and the Guest receives an email with a booking code.
• Bank transfer — after submitting the form the Guest receives an email with the account number, amount, transfer title and payment deadline. Until the money arrives the booking is provisional and the dates stay blocked. We send the confirmation with a booking code once the transfer is recorded.

For bank transfers the payment deadline is three days from booking, and for arrivals close at hand it falls two days before the check-in date — whichever comes first. If payment does not arrive on time, the booking expires and the dates are released. If there is less time left before arrival, booking by transfer is not available and we ask you to contact us directly.

A non-refundable rate applies: after payment the Guest is not entitled to a refund if they cancel of their own accord, subject to sections 4 and 6.

4. Date change

The Guest may make a one-time, free change of stay dates if requested no later than 7 days before arrival and the new dates are available.

If the new dates are more expensive, the Guest pays the difference in the same form used for the booking. If cheaper, the difference is not refunded.

5. No statutory right of withdrawal

Under Article 38 point 12 of the Polish Consumer Rights Act, the right to withdraw from a distance contract does not apply to contracts for accommodation services other than for residential purposes if the contract provides for a specific date or period of performance. The booking is for fixed dates — the statutory 14-day withdrawal right does not apply.

6. Cancellation by the property

If the property cancels the booking or cannot provide the service for reasons attributable to the Host, the Guest receives a full refund of the amount paid for the stay.

7. Invoices

An invoice is issued on request — select the option in the booking form or email kontakt@mtform.pl.

8. Complaints

Complaints should be sent by email to kontakt@mtform.pl. We respond within 14 days of receipt.
